General Terms and Conditions of Sale
1. General Provisions
1.1 Contracting Party
These general terms and conditions of sale govern all commercial transactions concluded between the online shop www.tentations.ch, represented by the sole proprietorship Shop4Fun Monnard, registered in Switzerland under the IDE number: CHE-157.066.250, hereinafter referred to as "the Seller", and any person making a purchase on the website www.tentations.ch, hereinafter referred to as "the Customer".
1.2 Modifications
The Seller reserves the right to modify these general terms and conditions of sale at any time. The applicable conditions are those in effect at the time of the order.
1.3 Acceptance
By confirming their order, the Customer acknowledges having read, understood, and accepted the general terms and conditions of sale below. He also acknowledges having reached the age of 18 at the time of the order.
2. Products and Orders
2.1 Product Description
The products offered for sale are described in detail on the website www.tentations.ch. The Seller strives to provide accurate and up-to-date information about its products but cannot guarantee the absence of errors or omissions. The details presented in the media (photos, videos, etc.) depicting the items may differ from the supplied product and are non-contractual. The decoration elements shown in the images are not part of the sold product.
2.2 Order Process
The order process is detailed on the website. The Customer is invited to carefully check their order before confirming it. Any confirmed order is considered firm and definitive.
3. Prices and Payment
3.1 Pricing
The prices of the products are indicated in Swiss francs (CHF) and include the applicable VAT. As of today, we are not subject to VAT, so the amount is 0%. Delivery costs, if any, are specified during the ordering process.
For orders with an amount less than CHF 20.00, an additional fee of CHF 9.90 will be charged.
For orders with an amount between CHF 20.00 and CHF 50.00, an additional fee of CHF 6.90 will be charged.
For any order with an amount equal to or greater than CHF 50.00, no additional fee will be charged.
The Seller reserves the right to change its prices at any time.
3.2 Payment Methods
Payment is made online at the time of order. The accepted payment methods are:
- Credit cards (VISA, Mastercard, Maestro, etc.)
- TWINT
- Google Pay
- Click to Pay
- Klarna (Pay now / Pay in 30 days / Pay in 3 instalments)
- Bank transfers
Payment information is processed securely, and the Seller does not retain the Customer's banking data.
Klarna Specificity:
When choosing invoice payment or payment in 3 instalments, the Seller transfers the responsibility for payment collection to the company Klarna. In case of late payment, Klarna’s general terms and conditions apply. Late payment interest may be charged to the Customer by Klarna. The rates and amounts applied are set by Klarna and not by the Seller. Any claims regarding these terms must be addressed directly to Klarna. No fees will be covered by the Seller.
3.3 Loyalty Points
A loyalty points system is in place for registered customers. "Guests" and "visitors" do not have access to loyalty points.
Loyalty points are awarded differently based on the "tier" reached by the customer. Each tier requires the customer to accumulate a specific number of points.
- **Iron** :
- between 0 and 250 points accumulated
- Earn 1 point for every CHF 1.50 spent
- **Bronze** :
- between 250 and 500 points accumulated
- Earn 1 point for every CHF 1.40 spent
- **Silver** :
- between 500 and 750 points accumulated
- Earn 1 point for every CHF 1.25 spent
- **Gold** :
- between 750 and 1000 points accumulated
- Earn 1 point for every CHF 1.15 spent
- **Platinum** :
- between 1000 and 1250 points accumulated
- Earn 1 point for every CHF 1.00 spent
- **Diamond** :
- More than 1250 points accumulated
- Earn 1 point for every CHF 0.90 spent
It is not possible to combine the use of loyalty points with a promo code.
The minimum cart value must be CHF 80.- to use loyalty points.
Loyalty points are valid for 365 days.
Each loyalty point is worth CHF 0.05. (100 points = CHF 5.-).
When loyalty points are used, the ‘tier’ adjusts and returns to the level corresponding to the new points balance.
The seller reserves the right to terminate the loyalty programme without notice. In such a case, the customer's outstanding loyalty points will be converted into a purchase voucher, based on the value at the time of termination of the programme.
4. Delivery and Shipping Times
4.1 Shipping
Our items are sold throughout Switzerland. The Seller undertakes to dispatch products as quickly as possible following order confirmation. The estimated delivery times are communicated to the Customer and vary depending on the availability status shown on each product page:
- “In stock”: the product is physically available in our warehouse. The estimated delivery time is generally 1 to 3 working days after order confirmation.
- “Available from supplier”: the product is not currently in our warehouse but available from our supplier. In this case, the delivery time is shown as x to y working days, depending on the supplier. These estimates are updated regularly.
These delivery times are indicative and may vary due to circumstances beyond the Seller’s control (strikes, war, pandemic, natural disasters, supplier delivery interruptions, etc.).
Our main logistics center is located in France. In some cases, and for logistical reasons, an order may be shipped directly from the warehouse in France. In such cases, the sender listed on the shipping label will appear as “NET-COMMUNICATION”, and the parcel must be received with a signature.
No additional customs or import fees will be charged to the Customer beyond the amount paid when placing the order, even if a separate invoice from Swiss Post appears on the package. Should such a case arise, please contact our customer service immediately at contact@tentations.ch so that we can handle these costs.
A copy of the invoice will be requested and verified with Swiss Post before being processed by our team. No direct refunds will be made to the Customer.
4.2 Delays and Solutions
In the event of significant delays compared to the estimated delivery times (for both “in stock” and “available from supplier” products), the Customer will be informed as soon as possible. Alternative solutions may be proposed, such as a partial refund of shipping fees, product replacement, or cancellation of the order if the item cannot be delivered within a reasonable timeframe.
4.3 Verification
The Customer must check the condition of the packaging and the goods upon receipt. Any damage or missing items must be reported immediately to our customer service, which will take the necessary steps.
4.4 Uncollected Shipments
For shipments requiring a signature, the Customer must confirm receipt with Swiss Post. If absent during delivery, the standard Swiss Post procedure applies. If a parcel is not collected within the legal time limit, the order will be returned to the sender or the Seller. The Customer will be notified by email, and the order will be stored for a maximum of 30 days. Return costs will be charged to the Customer. To receive the order again, the Customer must first pay the return costs and the new shipping fees. After 30 days, the order is considered refused, and the products become the property of the Seller. In this case, no refund will be issued.
The Seller reserves the right to charge additional fees for the storage of returned orders awaiting collection.
5. Right of Withdrawal and Returns
5.1 Withdrawal Period
In accordance with the legislation in force, the Customer has a period of 14 days from the receipt of the products to exercise their right of withdrawal. The return costs are borne by the customer. For reasons of hygiene and health protection, only unopened items in their original packaging can be exchanged or refunded. Each item will be checked before proceeding with the refund.
5.2 Return Conditions
Returned products must be in their original condition, unused, and accompanied by all accessories and documents. The return costs are borne by the Customer, except in the case of a defective product or a delivery error attributable to the Seller. See the details on the specific returns policy page.
6. Warranties and Liability
6.1 Legal Warranties
The products sold are covered by the legal warranty of conformity and the warranty against hidden defects in accordance with Swiss legislation.
6.2 Limited Liability
The Seller's liability is limited to the amount of the order. The Seller cannot be held liable for indirect damages, loss of profit, or any other financial loss suffered by the Customer.
7. Protection of Personal Data
7.1 Confidentiality
The Seller undertakes to respect the confidentiality of the personal data provided by the Customer. The collected information is used only in the context of order management and is protected in accordance with the data protection laws in force in Switzerland.
7.2 Exercise of Rights
The Customer can exercise their rights concerning their personal data by contacting the Seller.
8. Applicable Law and Jurisdiction
8.1 Applicable Law
These general terms and conditions of sale are subject to Swiss law.
8.2 Competent Jurisdiction
Any dispute relating to these general terms and conditions of sale will be subject to a prior attempt at conciliation with the company Shop4Fun Monnard before any legal action.
