These Terms govern the sale of products on www.tentations.ch. They are designed to remain clear while protecting both the customer and the seller.

1. Seller information and scope

1.1 Seller

These Terms & Conditions of Sale govern all transactions concluded between the online store www.tentations.ch, operated by Shop4Fun Monnard, a Swiss sole proprietorship registered under UID number CHE-157.066.250, hereinafter referred to as “the Seller”, and any person placing an order on the website, hereinafter referred to as “the Customer”.

1.2 Scope

These Terms apply to any order placed on www.tentations.ch and cover the sale of physical products delivered in Switzerland only, unless expressly stated otherwise.

1.3 Legal capacity and age

The Customer declares that they are an adult (18 years or older) and have the legal capacity required to enter into a contract.

1.4 Acceptance and communications

By placing an order, the Customer acknowledges having read and accepted these Terms without reservation. Order-related communications (confirmation, invoice, tracking, customer service) are sent by email. The Customer must provide a valid email address and check their spam folder as well.

1.5 Changes to the Terms and intellectual property

The Seller may amend these Terms at any time. The applicable version is the one in force at the time the order is placed. Website content (texts, photos, videos, graphics, logo, brand) remains the property of the Seller or its partners and may not be reproduced or reused without prior authorization.

2. Products

2.1 Description

Products are described with the greatest care. However, errors or omissions may occur. Photos and videos are non-contractual. Decorative elements shown in visuals are not part of the products sold.

2.2 Availability

Products are offered under two availability statuses:
In stock Physically available at the Seller’s premises.
Available from supplier Ordered from the supplier after the Customer places the order.

In case of unexpected unavailability, the Customer will be informed and a solution will be offered.

2.3 Adults only

The products offered are intended for adults. The Customer ensures that access to and use of the products is restricted to adults and that products are stored out of reach of minors.

3. Orders

3.1 Process

Any validated order implies an obligation to pay and is followed by an order confirmation email. The Customer must carefully check the information (products, quantities, address, contact details) before validation.

3.2 Binding order

The order is considered binding, subject to the cases provided for in these Terms.

3.3 Refusal or cancellation by the Seller

Possible cases
  • non-payment or incomplete payment
  • obvious pricing or description error
  • product unavailability
  • suspected fraud
  • previous unresolved dispute with the Customer

In such cases, any payment already made will be fully refunded.

3.4 Technical issues

In the event of a website malfunction, processing error, synchronization issue (stock, prices, content), or any anomaly beyond the Seller’s control, the order may be cancelled. The Customer will be informed and refunded in full for any amounts collected.

4. Prices

4.1 Currency and taxes

Prices are shown in Swiss francs (CHF). As the Seller is currently not subject to VAT, prices are displayed with VAT included at 0%. If the tax status changes, prices may be adjusted accordingly.

4.3 Pricing errors

In the event of an obvious pricing error, the Seller reserves the right to cancel the order and refund the Customer. If the Customer wishes to proceed at the corrected price, a new order must be placed.

4.4 Promotions

Promotional offers are valid only for the period indicated and while stocks last. Unless stated otherwise, promotions are not retroactive and do not apply to orders validated before the start of the offer.

5. Payment

5.1 Accepted methods

Payment cards, TWINT, Google Pay, Click to Pay, Klarna, bank transfer.

5.2 When payment is due

Except when using Klarna, payment must be made in full before shipment.

5.3 Bank transfer

For payments by bank transfer, funds must be received within 5 business days. After this period, the order may be cancelled.

5.4 Klarna

When paying via Klarna, payment management and any collection process are handled by Klarna under its own terms. The Seller declines all responsibility for any fees, penalties or interest applied by Klarna.

5.5 Retention of title

Products remain the property of the Seller until payment has been received in full.

5.6 Payment security

Payments are processed through secure providers. The Seller does not store bank card data. The Customer is responsible for keeping their login details and payment methods confidential.

6. Loyalty program

A loyalty points program is available for registered customers. Guests and visitors do not have access to loyalty points.
Tiers and earning
  • Iron: 0–250 points, 1 point per CHF 1.50 spent
  • Bronze: 250–500 points, 1 point per CHF 1.40 spent
  • Silver: 500–750 points, 1 point per CHF 1.25 spent
  • Gold: 750–1000 points, 1 point per CHF 1.15 spent
  • Platinum: 1000–1250 points, 1 point per CHF 1.00 spent
  • Diamond: over 1250 points, 1 point per CHF 0.90 spent
Rules
Value: 1 point = CHF 0.05 (100 points = CHF 5.00)
Minimum cart: CHF 80.00 to use points
Non-combinable: points and promo codes cannot be combined
Validity: 365 days
When points are used, the tier adjusts to the new balance.
The Seller reserves the right to end the loyalty program. In that case, remaining points will be converted into a voucher based on the value at the time the program is stopped.

7. Delivery

7.1 Delivery area

Delivery in Switzerland only.

7.2 Lead times

In stock: 1–3 business days
From supplier: lead time shown on the product page
Lead times are indicative and may vary for reasons beyond the Seller’s control.

7.3 Shipment from France

Some orders may be shipped from a French warehouse. The sender may appear as NET-COMMUNICATION and delivery may require a signature.

7.4 Customs charges

No customs clearance fees will be charged to the Customer. If Swiss Post charges fees in error, the Customer must contact the Seller immediately at [email protected]. A copy of the invoice may be requested for verification.

7.5 One single shipment

Shipping rule

As a rule, the Seller ships the order in one single shipment, even if it includes both “in stock” and “available from supplier” items. The overall lead time therefore corresponds to the longest lead time. Split shipments are possible only upon the Customer’s explicit request, and any additional shipping costs are borne by the Customer.

7.6 Transfer of risk

Risk transfers to the Customer when the parcel is handed over to the carrier. In case of delivery issues, the Seller will assist the Customer with the carrier’s investigation process as set out below.

7.7 Incorrect address provided by the Customer

The Customer is responsible for the accuracy of delivery details. If errors occur (incomplete address, wrong mailbox, missing name, missing access code), any return, rerouting or re-shipment costs may be charged to the Customer.

7.8 Uncollected parcels

If a parcel is returned because it was not collected, return and re-shipment costs are borne by the Customer. After 30 days, the order is deemed abandoned. No refund will be granted.

7.9 Parcel marked as delivered

Procedure

If the carrier’s tracking shows “delivered”, any dispute requires an official carrier investigation. The Customer must contact the Seller without delay with the order number and any useful information. The outcome depends on the carrier’s official conclusion (confirmed loss, delivery error, delivery confirmed, etc.).

8. Checking on delivery

The Customer must immediately check the condition of the parcel and products upon delivery.

  • provide clear photos (parcel, label, internal protection, product)
  • keep the packaging and filling material until the case is resolved

9. Seller-provided return right

9.1 Time limit

The Seller contractually grants a return right within 14 days from receipt. This right is subject to the conditions below.

9.2 Excluded products

Important (hygiene)

For hygiene and health protection reasons, opened, unsealed, tried-on or used products are neither taken back nor refunded.

This includes, for example: intimate toys and accessories, opened lubricants and cosmetics, opened hygiene products, and lingerie that has been worn or returned without its original tags/seal.

9.3 Procedure

Any return must be preceded by contacting customer service. The Customer must provide the order number and the reason for the return. Without prior agreement, the return may be refused.

9.4 Costs

Return shipping costs are borne by the Customer, except in case of Seller error (wrong product, defect confirmed on receipt). The Customer is responsible for the parcel until it is received by the Seller. Tracked return shipping is recommended.

9.5 Refund

After inspection, the refund is made using the original payment method. If the return does not comply with these conditions, no refund will be issued.

9.6 Acceptance conditions

  • product not used and not tried on
  • original packaging intact, complete, not damaged
  • all accessories, manuals, parts and seals/tags included
  • product adequately protected for return shipping

9.7 Refused return and return to the Customer

If the returned product does not meet the conditions above, the Seller may refuse the return. The product may be sent back to the Customer at the Customer’s expense.

9.8 Reference

Practical details may be provided on the dedicated return policy page on the website. In case of contradiction, these Terms prevail.

10. Warranties

10.1 Legal warranty

Products benefit from the warranty provided under Swiss law.

10.2 Exclusions

The warranty does not cover, in particular: normal wear and tear, misuse, failure to follow instructions, accidental damage, unauthorized modification, damage due to improper maintenance.

10.3 Procedure

The Customer must contact customer service with proof of purchase and a description of the defect. Photos or videos may be requested to assess the issue.

10.4 Remedy

Depending on the case, the Seller will choose the most appropriate solution: replacement, repair, store credit or refund, within the limits provided by law and subject to availability.

11. Product use

Products are intended for personal use and must be used in accordance with the instructions. They are not medical devices and do not replace professional advice. The Seller declines any liability in case of inappropriate, diverted or non-compliant use.

12. Liability

The Seller cannot be held liable for indirect damages, financial losses or loss of profit. Mandatory legal liabilities are not excluded, in particular in cases of gross negligence or product safety defects. The Seller is not liable for consequences arising from use that is not compliant with the instructions or for medical use.

13. Vouchers, gift cards and promo codes

13.1 Promo codes

Promo codes are subject to conditions (duration, minimum purchase, exclusions, possible non-combinability). Unless stated otherwise, promo codes cannot be combined with each other or with loyalty points and are not retroactive.

13.2 Vouchers and gift cards

  • Vouchers and gift cards are not redeemable for cash and are non-convertible.
  • They are valid until the date indicated, where applicable.
  • In case of loss, theft or unauthorized use, no replacement is guaranteed.
  • Unless stated otherwise, use follows the conditions communicated at issuance (partial use allowed or not, combinability rules, etc.).
  • In case of suspected fraud or abusive use, the Seller may temporarily suspend use while verification is carried out.

14. Personal data

Personal data processing is described in the Privacy Policy available on the website. Data necessary for the order is used for management, fulfillment and after-sales support.

The Customer has rights of access, rectification and deletion according to applicable law. To exercise their rights, the Customer may contact the Seller. The Customer may unsubscribe from marketing communications, where applicable, without affecting emails required for order processing and tracking.

15. Force majeure

The Seller shall not be held liable in the event of force majeure preventing total or partial performance of the contract (for example: strikes, natural disasters, conflicts, epidemics, transport disruptions, supplier unavailability).

16. Governing law and jurisdiction

These Terms are governed by Swiss law. Jurisdiction is at the Seller’s registered seat, subject to mandatory legal provisions.

If any clause of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
